An unprecedented decision: CJI granted permission to CBI for investigating against HC judge

As a response to a formal appeal by the CBI, the Chief Justice of India, Ranjan Gogoi has granted permission to probe an investigation against the HC Judge. This is the first time that any CJI has allowed an investigation against the HC judge. 

The decision came in the Tuesday morning when the CJI Gogoi wrote to the CBI “I have considered the note appended to your letter on the above subject. In the facts and circumstances of the case, I am constrained to grant permission to initiate a regular case for investigation as sought for in your letter under reference.” 

Earlier, the CBI wrote to CJI seeking permission to probe an investigation and lodge FIR against the Allahbad HC sitting Judge SN Shukla under the prevention of corruption Act. No investigation of this nature has been taken place till now. In1991, in the case of K Veeraswamy, the supreme court denied any permission to any investigation agency to lodge FIR against a sitting Supreme court or High court judge. 

The investigation and the case is based on the alleged favours to a private medical college by extending the date of admissions. It is also important to note that last month CJI wrote to Prime Minister Modi to remove Justice SN Shukla to move a motion in the parliament. This will definitely give a major turn to the case and will register itself in one of the important cases related to the parliament. As an unprecedented decision, it has already made its way to register itself in the historicals decisions.
