The long awaited bill for instant triple talaq or talaq-e-biddat has been finally passed. The government has passed the bill in the winter session of Parliament. Hence, the act of instant triple has become crime and the husband will be jailed for three years. Whether it is written, oral or electronic, all forms of Instant triple talaq has been banned and made a cognizable offence.

‘Muslim Woman Protection of Rights on Marriage bill’ also proposes to undertake all cases of instant triple talaq across India except the Jammu and Kashmir.

As per this bill, a harassed Muslim woman and her dependent children will get a subsistence allowance. There is also provision for custodial rights of minor children.

How this bill came into being?
Instant triple talaq is a big issue faced by muslim women. Hence, it was proposed to ban this talaq system. This decision to call instant triple talaq as illegal and unconstitutional was given by government in August.

The draft to ban the act of instant triple talaq was prepared by Prime Minister Narendra Modi, Home Minister Rajnath Singh, External Affairs Minister Sushma Swaraj, Arun Jaitley, Law Minister Ravi Shankar Prasad and his junior in the ministry P P Chaudhary.
