H1B visas approval gets tough, Impact Indian IT companies

It is now getting tougher to get H1B visa approval. As the new policy from trump administration will make it difficult for immigrants to get the approval. This will definitely impact the IT companies. In Indian IT companies, going for third party work sites is a common phenomenon. This new policy has come few weeks before of filing H1B visas which is expected to be 2 April.

What is so critical with new policy?
Under this new policy, the company would have to go an extra length to prove that its H-1B employee at a third-party worksite has specific and non-qualifying speculative assignments in specialty occupation. The issuing of H-1B visas may now also be for less than three years. With this new policy, the extensions of H-1B visas have become even tougher especially if the emoloyee has been on a bench for any part of their previous duration. Now, the companies that want H1B visas for their employees working at a third-party site have to face intensive paper work to file before submitting their applications.

Impact of this new policy
With this new policy, not only Indian companies but also American companies will be affected. There are a large no. of Indian professionals hired by American banking, travel and commercial services. Hence both the countries will face repercussions of this new policy.

This policy for H1B visa has been brought as a part of President Donald Trump’s ‘Buy American and Hire American Executive Order’. This policy is meant to protect the interests of US workers.
