Mohammad Shahabuddin’s bail plea rejected by Supreme Court and decided to sent him back to Jail

Mohammad Shahabuddin, a man born on 10th May, 1967, is a criminal turned politician and was elected four times as a Member of Parliament from  Siwan, Bihar, with the Rashtriya Janata Dal (RJD) party of Lalu Prasad Yadav, and 2-times as MLA, to the Bihar Vidhan Sabha (Legislative Assembly). And, the first criminal case was filed against him in 1986, since then, this criminal has just escalated his position in the world of crimes.

There are various criminal cases filed against him but still he got a bail granted by Patna High Court on September 11, 2016, and he walked out of the Bhagalpur Special Central Jail. But today, the Supreme Court has set aside the Patna High Court order granting bail to this controversial RJD leader Shahabuddin in a murder case.

The Supreme Court has ordered that whether the criminal turned politician should willingly offer himself for the custody or the Bihar Police would take him in custody “Forthwith”.

The bail plea was rejected by a bench comprising of Justice P C Ghose and Amitava Roy who directed the state government and lower court to ensure that trial in the Rajiv Roshan murder case is concluded: “expeditiously as contemplated under the law”. The decision is taken after considering the facts of the case and evidence on record. It said, ““The state government shall take all steps to comply with the orders of the court.” Also, the apex court has directed to speed up the proceedings of the gangster-turned-politician.

In the double murder case, Shahabuddin was convicted and sentenced to life term. The famous senior lawyer Prashant Bhushan had argued in front of the Supreme Court that Shahabuddin “walked out of jail at will” without following any rules.  “The jail authorities were terrified of him. Bhushan sought cancellation of bail of Shahabuddin on the ground that if he is enlarged on bail, then the life of the last witness, who testified in a case, would be in danger,” Bhushan had said.

The Apex Court has also thrashed the lower court for the delayed action on this gangster in other 45 cases. “Why have you (Bihar) approached the court only after his release? Were you in slumber till he got bail? This is a peculiar case. But the question is what is the peculiarity with this particular case and on whose instance this peculiarity has been identified,” said the bench of Justices P C Ghose and Amitava Roy.

Shahabuddin has been in jail for more than 10 years because of his connection in multiple cases of murder, extortion, and kidnapping.
