Petition seeking ‘Governor’s Rule in Kashmir’ is rejected by Supreme Court

The continuous conflict and situation of disharmony have overcome the valley of Jammu and Kashmir. The situation is getting difficult with each hour after the killing of Burhan Wani, who was a terrorist. Some anti-national elements have made it difficult for the people of the valley to live peacefully and created chaos everywhere.

The J&K National Panthers Party has applied a Public Interest Litigation (PIL) in the Supreme Court on July 22, asking for Governor’s Rule in J&K. Jammu and Kashmir National Panthers Party led by Bhim Singh had filed a petition seeking direction to the Governor to intervene under section 92 of the Jammu and Kashmir constitution which meant a rule by the Governor. But the Supreme Court on Friday has rejected the plea seeking Governor’s Rule in Kashmir. The Apex Court has also asked General Ranjit Kumar, who is Modi Government’s Solicitor, to file a ground level status report of the valley by Monday.

Chief Justice Thakur said that “Situation at the grounds changes in hours, these are not the issues that could be judicially dealt with”.

Bhim Singh is of the opinion that the people of the state are in trouble and their fundamental right to life is hampered due to non-availability of food, medicines and all the other essential services. Also, there is no telecommunication in the state as the Mobile Companies have suspended their prepaid services. The bench then advised him to approach the State High Court.

During the hearing, the Bench also warned Singh to not take the political advantage of the situation. He was advised to keep the politics out of the court. “Make sure you don’t fight your political battles in the court. We will come down heavily on you if we get the feeling that you are taking political mileage” said Justices AM Khanwilkar and DY Chandrachud.

It was on the same day that Union Home Minister Rajnath Singh had a conversation with J&K Chief Minister Mehbooba Mufti over the phone to discuss the ongoing situation in the valley.

The valley is in a paralyzed state for more than 2 weeks because of re-imposed curfews and extreme security. The situation is very much complex in the Anantnag, Kulgam, Pulwama and Shopian districts and the normal routine life has come to a halt. Till now, around 44 people have died and more than 2,000 have been injured in agitations and protests across Kashmir since Hizbul Mujahideen Chief Burhan Wani was killed on July 8.
